These Terms & Conditions (“Terms”) govern your use of everhaus.club (the “Site”), your submission of a membership inquiry, and your participation in the Everhaus text messaging program. Everhaus (“Everhaus,” “we,” “us,” or “our”) is a private health and lifestyle club in Las Vegas, Nevada, owned and operated by Highgarden Holdings.
By using the Site, submitting an invitation request, or opting in to receive text messages from us, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. SMS / Text Message Program Terms
These terms govern the Everhaus text messaging program and apply in addition to the rest of these Terms.
Program description
Everhaus operates a text messaging program that sends membership information and updates to individuals who have asked to receive them. Messages may include responses to your inquiry, appointment scheduling and reminders, and club communications.
Consent
You enroll by affirmatively checking the SMS opt-in box on our invitation request form, which constitutes your prior express written consent under the Telephone Consumer Protection Act (TCPA) to receive text messages from Everhaus at the mobile number you provided, including messages sent using an automatic telephone dialing system.
Your consent to receive text messages is not a condition of membership and is not required to purchase any goods or services from Everhaus. The opt-in box is never pre-checked, and we never treat providing a phone number, by itself, as consent to be texted.
By opting in, you confirm that you are at least 18 years old and that you are the subscriber to, or the customary user of, the mobile number you provided. If that number is reassigned or you stop using it, you agree to notify us at info@everhaus.club.
Message frequency
Message frequency varies depending on your interaction with us. We do not send a fixed number of messages per period.
Message and data rates
Message and data rates may apply. Any charges are billed by and payable to your mobile carrier under your wireless plan. Everhaus does not charge you for text messages. Contact your carrier with questions about your plan.
How to opt out
To stop receiving text messages, reply STOP to any message from us. You will receive one confirmation message, after which we will send no further texts to that number. You may also opt out by emailing info@everhaus.club.

Carrier disclaimer
Carriers are not liable for delayed or undelivered messages. Message delivery depends on effective transmission by your mobile carrier and on factors outside our control, including network availability and your device settings. Everhaus does not guarantee that any message will be delivered, or delivered on time.
Supported carriers and changes to the program
The program is supported by major U.S. wireless carriers. Carriers may not be held liable for delayed or undelivered messages. We may modify or discontinue the program, or any of its features, at any time without notice.
Privacy
Your mobile number and your opt-in consent are handled as described in our Privacy Policy. No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.
2. Membership Inquiries
Everhaus is a private club and membership is by invitation. Submitting an invitation request or membership inquiry:
- Does not create a membership, and does not entitle you to one.
- Does not obligate Everhaus to extend an invitation, and we may decline or decide not to respond to any inquiry at our sole discretion.
- Requires that the information you submit be accurate, current, and your own. Do not submit another person’s information without their permission.
Membership, once extended, is governed by a separate membership agreement. Where that agreement conflicts with these Terms, the membership agreement controls as to membership matters. Membership dues, fees, and benefits are set out in that agreement and may change as provided there.
3. Use of the Site
You may use the Site for lawful, personal, non-commercial purposes. You agree not to:
- Submit false, misleading, or fraudulent information, including automated or spam submissions.
- Attempt to gain unauthorized access to the Site, its servers, or any related systems or data.
- Interfere with or disrupt the Site, including by introducing malware or by scraping, harvesting, or overloading it.
- Use the Site or its contents for any commercial purpose without our written permission.
- Use the Site in violation of any applicable law or regulation.
We may suspend or terminate access to the Site, or remove any submission, at our discretion.
4. Intellectual Property
The Site and its contents — including text, images, photography, video, graphics, layout, and the Everhaus name and marks — are owned by Everhaus or Highgarden Holdings, or used under license, and are protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.
5. Third-Party Links and Services
The Site may link to or rely on third-party websites and services, including our payment processor and scheduling provider. We do not control those third parties and are not responsible for their content, practices, or availability. Your dealings with them are governed by their own terms and privacy policies.
6. Health and Wellness Disclaimer
Nothing on this Site, and no message we send you, is medical advice. Everhaus provides health, longevity, and lifestyle services in a private club setting; it does not practice medicine or provide diagnosis or treatment through the Site. Content on the Site is general information only and is not a substitute for advice from a qualified healthcare provider. Always consult your physician before beginning any health, fitness, nutrition, or longevity program, and never disregard or delay seeking professional medical advice because of something you read here.
7. Disclaimer of Warranties
The Site and our communications are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any information on it is complete, accurate, or current.
8. Limitation of Liability
To the fullest extent permitted by law, Everhaus, Highgarden Holdings, and their officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or relating to your use of the Site or our services, or to any delayed or undelivered text message — whether based in contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms, the Site, or the text messaging program will not exceed one hundred U.S. dollars (US $100.00). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless Everhaus, Highgarden Holdings, and their officers, directors, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of your use of the Site, your submissions, your breach of these Terms, or your violation of any law or third-party right.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Clark County, Nevada have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the Site, and you consent to personal jurisdiction and venue there.
11. Changes to These Terms
We may update these Terms from time to time. Revisions take effect when posted to this page, and we will update the “Last updated” date above. Your continued use of the Site or the text messaging program after a change means you accept the revised Terms.
12. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will stay in full force. These Terms, together with our Privacy Policy, are the entire agreement between you and Everhaus regarding the Site and the text messaging program. Our failure to enforce any provision is not a waiver of it.
